Washington State Audit Prompts Desire for Ongoing Criminal Monitoring of Child Care Workers and Foster Parents

Officials in Washington state are calling for a “rap-back” notification system to be put in place to help them keep track of alleged criminal activities committed by workers in positions of trust. Child care workers and foster parents are the main focus at the moment, but this system could easily be expanded to include other occupations like teachers and nursing home workers.

Right now, child care workers and foster parents are required to pass criminal background checks prior to employment. However, once they pass the background check, they are essentially in the clear. No one checks up on them again, so they could potentially become involved in criminal activity with no one being the wiser.

With a “rap-back” system in place, officials would receive automatic notifications each time a worker was involved as a suspect in any sort of criminal investigation. Eatontown Firefighters and First Aids Squads May Be Required to Pass Recurring Background Checks

At the end of last month the Borough Council of Eatontown met to discuss an amendment that will require recurring background checks on all members of firefighters and first aid squad members. If passed, this ordinance amendment will require all of these first responders to undergo a fingerprint-based background check every three years that they are a part of the organization. Before drafting the amendment, the idea was discussed first with the first emergency responders who had no objections.

Currently, all firefighters and first aid responders are required to submit to fingerprint-based criminal background checks upon hiring, but there are no follow--up checks. Borough Administrator George Jackson states that "We have no way of knowing in the interim if they have any arrests and convictions. The possibility is that someone could be arrested or convicted in another part of the state and we'd have no idea." Since these first responders have access to people's homes, Jackson wants to ensure that they have no criminal activity on their records for as long as they are working for these emergency first responder units. This will not only bring peace of mind to the civilians, but also help protect these units from any potential liability. Jackson states that the council is also discussing if the amendment should include members of the borough's Office of Emergency Management and Community Emergency Response team. Unfortunately, their membership policies are not as clear cut as those for the fire department or the first aid squad.

Currently, there are no discussions on requiring recurring checks of other employees, such as police officers and civilian employees of the court or law enforcement. Like the firefighters and first aid responders, they undergo an initial criminal background check with no follow-up checks. Jackson states the borough would be aware of police officers convicted of crimes in other jurisdictions. It's unclear how they will become aware, though it's possible that the borough receives reports from other counties regarding their own police officers.

Currently, Eatontown is one of the first cities in the United States to discuss implementing a recurring background check. Audit Finds Sex Offenders in State-Funded Child Care and Foster Homes

A recent audit has found that during a ten year period from 2002 to 2012, there were twenty-eight sex offenders living in child care and foster homes regulated or subsidized by Washington State, including one who worked for nine years in a high school as a janitor. The review stated that the problem could be prevented if state laws were followed more strictly, and offered several recommendations for procedures the state should follow to better keep children safe from sex crime offenders. However, the auditor’s office spokeswoman, Mindy Chambers, said the state agencies should be commended for taking action to quickly improve procedures after learning about the problems. Lawmakers contend that the audit shows more should be done in order for children to be protected, including improved communication and background checks.

State Representative Bruce Dammeier said he was very concerned that only certified school workers such as teachers and librarians were regularly being checked against sex offender lists. Since 2005, Washington State law has required that any school employee must be searched for in the State Patrol’s sex offender database. Dammeier said that while he was glad to see that an auditor ran the database check and “that they only uncovered one (school) employee with a sex offense…one is too many.” The school janitor that the audit uncovered had initially passed his background check, but within two years was convicted of voyeurism, while continuing to work at the school. State law enforcement officials failed to alert the school district or education department of the offense. The State Patrol was also faulted by the audit for failing to disclose conviction information provided by other states.

Seventeen of the remaining sex offenders the audit uncovered were living in residences operating as home child care providers, and 11 resided in foster care homes. In most of these cases the offenders were undetected due to the care providers neglecting to inform state agencies that the offenders were living there, according to the audit. Two of the home daycares were licensed as Department of Early Learning Child Care Sites, and one had its license revoked while the other ceased operations. In the foster home cases, children were removed from homes and licenses were revoked. State Senator Mike Carrell said next year he would like to introduce a bill that would look more closely at unlicensed home daycares to make sure sex offenders were not working or living there.

Charity Director Accused of Theft Was Convicted of Similar Crime

A Spartanburg, South Carolina charity that provides services to low-income residents is now looking at nearly $40,000 less in their funds to help the needy. Former director of TOTAL Ministries, Karen Bradley, was arrested on charges that she stole from the charity. After her arrest, it was discovered that she also committed a similar crime about 13 years ago. Bradley admitted to stealing $11,000 from a Mobile Alabama non-profit in 1999. Bradley acted as the executive director for TOTAL Ministries from July 2010 until March 2012, at which time she was fired. When Bradley began working for the charity, they were not performing background checks on potential employees.

In 1998, Bradley was working for the Mobile Arts and Sports Association (MASA) as a ticket manager for a charity football event known as the Senior Bowl. MASA said they have donated millions of dollars to charities in the community since 1951. An audit revealed the non-profit was missing thousands of dollars from the time Bradley was employed with them. She was later arrested and in 1999 pleaded guilty to stealing $11,000, receiving a one year suspended sentence. This time, Bradley stands accused of allocating nearly $40,000 of TOTAL Ministries’ funds for personal use. She also used the charity’s credit card for purchasing groceries, personal electronics, meals, and more. After receiving information that there was a problem with the books, the board of directors fired Bradley.

Now, TOTAL Ministries faces a possible fine from the South Carolina Secretary of State’s Office for making false statements. All non-profits in the state are required to register with the office to solicit forms, and must vow on the form that none of their directors or board members has committed any crimes against a charitable organization in the U.S. Since the charity failed to perform a background check on Bradley, they said no. Mark Hammond, S.C. Secretary of State, is asking TOTAL why they would check no to the question without checking the backgrounds of their employees. TOTAL’s interim director, Traci Kennedy, said she was unaware of Bradley’s criminal past, and going forward they will perform background checks on all of their employees. Bradley has been charged with fraud and is currently awaiting sentencing.

School Board Member Questions School District’s Background Check Policies and Urges Repeat Checks

School board member John Dutcher of the Johnston Community School District Board of Education isquestioning why the school district only conducts background checks at the time of hire and not during contract renewals. Dutcher voiced his concerns during a recent Board of Education meeting to approve renewing the contract of Johnston School District Superintendent Clay Guthmiller. Dutcher was the only board member who opposed the contract renewal. A two-year contract with Guthmiller was approved, which includes a 3.25 percent salary raise. After the meeting Dutcher said his “no vote on the contract is self-explanatory,” and doesn’t “share in other board members’ desire” for Guthmiller to continue his employment with the district.

During the meeting, Dutcher questioned the school district’s background check policies, and recommended the district do more thorough investigations on employees. He gave a hypothetical example of a district employee possibly obtaining a part-time administrative position. He said if that happened without a background check, that it “would be unfortunate.” Dutcher declined to mention any specific reservations he may have had regarding Guthmiller, and if his reason for rejecting the contract renewal was related to the lack of a recent background check. The district’s Associate Superintendent of Human Resources, James Casey, said that the policy was to only conduct background checks on potential hires, but certain legal troubles could result in termination for current employees. While the renewal of Guthmiller’s contract does not call for another background check, it does require an annual performance evaluation.

Greg Dockum , also a Johnston School Board member, is in agreement with the current policy on background checks held by the school district. He said it would be “highly unusual” to conduct a check “on a long-tenured employee.” Dutcher defended his stance by saying as a member of the school board it is his duty to ensure that “the best possible decisions” are made to benefit the community and employees of the school district. However, Marci Cordaro, Board President, remarked that Dutcher is often critical of district decisions. She said she doesn’t “know for sure why he voted the way he did.”

New Hampshire School Introducing Background Checks for All Visitors

Administrators at Hollis Brookline High School in Hollis, New Hampshire, have announced they would like to implement required background checks on all visitors to the school, as part of new security procedures. According to Principal Cynthia Matte, “the security of our students and staff is the number one priority.” “We do need to add some security measures; it’s just good practice. When this school was built, security wasn’t thought of as a requirement, and we’re just trying to correct that.” The new security procedures come after a security audit performed at the school five years ago, and is comprised of a three-phase plan to improve the school’s security as part of a joint effort by school staff members and local safety experts.

Presented to the school board in May, the plan is still pending approval. If approved this summer, the plan will be implemented over the course of three years. The background check phase of the plan would include the use of software to scan the driver’s licenses of visitors to screen for registered sex offenders, domestic violence offenders, and other offenses that could potentially pose a threat to students. The software would instantly alert designated officials via email, telephone and text message if a threat is identified. An ID badge is printed for visitors cleared by the software. At a cost of $500 annually, the software would also track faculty and volunteer hours, as well as the arrival and departure of students.

New ID cards would be issued to students and staff, as well as hardware to secure all exterior doors and the installation of key swipe pads at the front and back doors, as part of the first phase of the plan. Cameras at each exit are also included. The keypads track who comes into the building and at what time, and can be programmed to work only at certain times of the day or year only. Although Matte says the school has already made some of the smaller changes recommended by the audit, more needs to be done. “It’s something that’s been on our radar, knowing that we have to tighten up security,” she said. She adds that due to increased incidents of school violence, the staff at the high school is taking a more proactive approach to security measures.

Dating sites and California attorney general announce partnership agreement to screen for sex offenders

Sites including eHarmonay and Match.com announced that they have entered into a partnership agreement with the California attorney general to better protect their respective dating sites members, including implementing policies and proceduers to screen their subscribers and members against sex-offender databases.

The development of this agreement stems from a lawsuit filed in 2011 against Match.com by one of their users,  who was attacked by another Match.com member after going on a date with him, follwowing a match proposed by the site. After the attack was investigated it turned out that the man was a repeat sex offender. As part of a settlement Match.com reached with the plaintiff in August of last year, they already agreed to start screening their members for possible matches against sex offender registries.

At the time many speculated that Match.com's policy would be followed by others in the industry, such as eHarmony. With the announcement today that expectation is now confirmed and others are urged to join the practice and the agreement.

Kentucky Bill Would Require Fingerprinting and Background Checks for Nursing Home Workers

The state of Kentucky is taking steps to ensure that all of their elderly residents who live in long term care facilities will be safer by attempting to pass a bill that would require all employees to undergo fingerprint based full criminal background checks. This would constitute a huge improvement over how screening has been done in the past.

Currently, in Kentucky, a person who is employed by a long term care facility must go through a background check that only searches state records. There is no search of national records, nor are the background checks specifically deep or detailed. The newly proposed background checks in the bill will search national databases for any criminal abuse convictions via a combination of name and finger prints. The new system would also use continuous monitoring of employee names which would alert the state and facilities if one of their employees was involved in any crime. The state of Kentucky currently has about 24,000 employees working in long term care facilities and all of them would be subject to these new background checks if this bill is passed.

The cost of the background checks would be taken care of by a grant that the state was given by the Federal government. Along with a state grant, it is thought that the state would be able to pay for these background checks until 2014. At that point, the state facilities would have to pay for the background checks themselves or pass the fee along to applicants and employees. The bill has been passed by the Kentucky state Senate and has been moved on to the state House.

Up to 35% of Los Angeles County Child Welfare Workers have No Background Check

It has come to light that an estimated 35% of all county child welfare workers in Los Angeles County have never gone through a criminal background check. The county Board of Supervisors has ordered that employees who slipped through the cracks immediately get background checks done. As part of the background check they will need to be fingerprinted and put through a criminal background check before going back to work.

The county currently requires that all new employees as well as those who are given a promotion go through a background check.  On top of that, other county employees, like those who work for the park service, are also subject to these background checks. The problem was, these checks are only done at hiring or promotion and somehow they now have about 35% of their employees who slipped through the cracks. For many people, this is simply unacceptable and even though the county has taken swift action to correct this, they still want answers as to why these background checks were not done in the first place on such a large percentage of the employees.

County leaders do admit that they consciously did not require background checks back  in 1997, the year these checks became mandatory, but that is unlikely to make up 35% of their staff. At this point, it is unknown what will happen to employees who fail these background checks, but in other cases around the country they were often terminated.

Los Angeles County states that they have an effective system for background checks. As mentioned above, a fingerprint check and criminal check are done when a person is hired, but that type of check simply may not offer enough coverage. Especially those who work with children in the Welfare office must be criminally clean and be trusted to offer an abundance of care and support for kids, many who may be abused. The state of Illinois has a mandate that all teachers in all schools go through a criminal background check before being able to work in the state. For some, however, the background checks that are currently being done are simply not enough. An incident in late December, where a school custodian, Kenneth Brown, exposed himself to a female teacher, caused this call for change. Though no students were present at the time, the fact that it happened at all is alarming to many school officials and parents.

Officially, Illinois state law focuses only on those school employees who were hired after 2004. Those hired before that time were never required to go through a background check. Since Brown has been employed at the school since 2000, his background, which is littered with petty crimes like theft, was never put through a full criminal background check. Employees who go through the full background check are subject to fingerprinting and are made ineligible for employment should there be any crimes like drug offenses or felonies. Theft, like the crime committed by Brown, is also included, however he was grandfathered in and fell through a loophole.

Another concern from parents and district leaders is the fact that Naperville school employees are only required to go through a background check when they are hired, not after that. Technically there could be teachers or other employees who are working at Naperville schools who have a criminal background, but the crime was not committed until after they were hired. There are many instances where a person could be accused of a crime and the workplace would never know unless someone stumbled upon public records.

Suggestions to change this are being tossed around and one of them is that a random background check be done on ten percent of all employees each year.  Another suggestion is to use a third party background check company like backgroundchecks.com which offers several products that would help the school district keep tabs on any crimes committed by their employees.
