Ohio Enacts a New Medical Marijuana Law

On May 25, 2015, the Ohio Legislature passed House Bill 523 which legalizes the prescription and use of medical marijuana for individuals with serious medical conditions. Governor John Kasich signed the bill on June 8, 2016, and it will take effect on September 8, 2016.

Connecticut Passes the Amended Ban the Box Bill

Connecticut passed an amended version of House Bill 5237 relating to employment-related protections for people with a criminal conviction record. The modified “Ban the Box” bill states, “No employer shall inquire about a prospective employee’s prior arrests, criminal charges, or convictions on an initial employment application, unless (1) the employer is required to do so by an applicable state or federal law, or (2) a security or fidelity bond or an equivalent bond is required for the position for which the prospective employee is seeking employment.” The new law allows an employee or prospective employee to file a complaint with the Labor Commissioner alleging an employer’s violation.  The amended parts of the bill will go into effect on January 1, 2017.

Fixing Turnaround Times in Virginia

In April of this year, Virginia removed Year of Birth from all court records. This is causing all potentially adverse records to require court intervention for verification of Year of Birth, leading to turnaround times of 4-6 weeks. This is affecting all background screening companies performing searches in Virginia.Please note that potential adverse information is also potential clear information.     The Colorado legislature passed House Bill 1265 that prohibits the reporting of expunged criminal history. Governor John Hickenlooper, Jr. signed the bill on June 10, 2016 and it goes into effect immediately.
