Third Circuit Court of Appeal Rules on Use of Bankruptcy Reports

This leaves private employers the right to reject a job applicant based on a bankruptcy filing.

The Third Circuit Court of Appeal has jurisdiction over District Courts in Pennsylvania, New Jersey and Delaware. While this ruling will be precedent in other states, the circuit courts for the other circuits may ignore this precedent. Therefore, employers should still be wary of adopting new requirements barring bankrupt individuals from employment.
