Governor Corbett has signed Act No. 127 (formerly Senate Bill 637), The Public Works Employment Verification Act, requiring Pennsylvania state public works contractors and subcontractors to begin using E-Verify.
Public works contractors and subcontractors must comply by January 1, 2013.
Failure to use E-Verify to ensure that employees are legally able to work in the U.S. can lead to a number of sanctions. This includes:
- First violation: Warning letter sent and posted on department’s website.
- Second violation: Debarment from public works for 30 days.
- Third and subsequent violations: Debarment from public works for 180 days to 1 year.
- Willful violation: Debarment from public works for 3 years.
